STUDENT TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of tutoring services provided by One World Classroom ("Platform", "we", "us", or "our"). By purchasing a tutoring package or scheduling a session, you ("Student", "you", or "your") agree to be bound by these Terms. Please read them carefully before making a purchase.

1. Services Provided

1.1 Tutoring Services.

One World Classroom provides online tutoring services across a broad and growing range of subjects. This includes, but is not limited to, university-level STEM subjects (such as Mathematics and Engineering), school-level subjects, general education and professional preparation subjects (such as IELTS, TOEFL, and other language proficiency programmes), and specialist subjects serving specific learner groups (including medical and healthcare students). All sessions are conducted via video conference (Zoom or Google Meet) with qualified tutors. Sessions are always scheduled in full-hour blocks, with a minimum duration of one hour. The range of subjects and learner groups available on the Platform may be expanded from time to time at One World Classroom's sole discretion, and nothing in these Terms shall limit such expansion.

1.2 Platform Role.

One World Classroom acts as an intermediary platform connecting students with independent tutors. We facilitate bookings, payments, and scheduling. Tutors are independent contractors who deliver educational services on their own responsibility. We are not an educational institution and do not award degrees, certificates, or academic credits.

1.3 No Guarantee of Results.

Although our tutors are highly qualified, we cannot guarantee specific academic outcomes, exam grades, or grade improvements. Your academic success depends on many factors including your effort, attendance, engagement, and prior knowledge.

2. Packages and Pricing

2.1 Booking Channels.

Sessions and packages may be booked through four available channels on the Platform:

Channel 1 β€” Personalized Session (Bring Your Own Problem)

Bring a specific topic, exam question, or concept you are stuck on. Your tutor prepares tailored material just for your session. You choose the subject, describe your problem, select your tutor and time slot, and pay for your chosen duration. The applicable rate for your chosen duration is displayed at the time of booking and confirmed before payment. Purchases under this channel may be for a single hour or a multi-hour block.

Channel 2 β€” Structured Learning Packages (Pre-Designed Package)

Expert-designed packages with clear structure, defined topic coverage, and session delivery options. Duration and pricing are shown upfront.

Channel 3 β€” Session Library (Choose Favourite Sessions)

Browse every individual lesson available across all subjects. You may book a single session or multiple sessions in any order and combination. Filter by subject, level, and duration.

Channel 4 β€” Full Exam Paper Review (Mock Exam Review)

A tutor-led review of a complete model exam paper. Each exam paper review is structured as one or more full-hour sessions (for example, two sessions of two hours, or one session of three hours) as specified at the time of booking.

2.2 Pricing and Payment.

All prices are in Euros (EUR). As a small business operator under Β§ 19 UStG (Umsatzsteuergesetz), One World Classroom does not charge VAT. No VAT is included in or added to any price displayed on the Platform. Payment must be made in full at the time of purchase via Stripe. We accept major credit cards, debit cards, and other Stripe-supported payment methods.

2.3 Package Validity.

Purchased hours must be used within 60 days from the date of purchase. In cases of documented tutor unavailability attributable to the Platform, the validity period may be extended at One World Classroom's sole discretion upon written request to info@oneworldclassroom.de. The validity period is also subject to automatic extension in force majeure circumstances as set out in Section 8.3. Unused hours that expire after the validity period without either exception applying are non-refundable.

3. EU Consumer Rights and Right of Withdrawal

3.1 Statutory Right of Withdrawal.

In accordance with the EU Consumer Rights Directive 2011/83/EU and applicable national consumer protection law, you have the right to withdraw from your purchase within 14 calendar days of the date of the contract without giving any reason. This cooling-off period applies to all purchases through booking channels.

Withdrawal Notice:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date the contract was concluded.

To exercise your right of withdrawal, you must inform us by means of an unambiguous declaration (e.g. a letter sent by email) of your decision to withdraw from this contract:

You may use the model withdrawal form set out in Annex 1 to these Terms, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal:

If you withdraw from this contract, we shall reimburse all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

3.2 Expiry of Right of Withdrawal for Completed Services.

By scheduling and attending your first tutoring session, you expressly request that we begin providing services immediately and acknowledge that your right of withdrawal expires upon full completion of each session for which the service has been provided. The right of withdrawal remains in force for any uncompleted or unscheduled hours within the 14-day period.

Example: You make a purchase on Day 1. On Day 8 you complete a 2-hour session. On Day 10 you wish to withdraw. You receive a refund calculated as the pro-rata value of all unused hours remaining under your purchase. The 2 completed hours are non-refundable as the service has been provided.

3.3 Exercising the Right of Withdrawal.

To withdraw, send an unambiguous written declaration within 14 days of your purchase date to info@oneworldclassroom.de, including your name, order number, and confirmation of withdrawal. We will acknowledge your withdrawal within 2 business days and process your refund within 14 calendar days.

4. Cancellation and Refund Policy

Section 4 applies to all purchases on the Platform regardless of booking channel. For the purposes of this section, a 'purchase' means any payment made through the Platform, whether for a single session, a custom session block, a pre-designed package, or individual session library bookings. The term 'first scheduled session' refers to the earliest booked session under a given purchase. The notice-period-based refund tiers in this section apply outside the 14-day statutory withdrawal period. During the withdrawal period, Section 3 governs.

4.1 Complete Purchase Cancellation (No Sessions Completed).

If you wish to cancel your entire purchase before completing any sessions:

  • Cancel 7+ days before your first scheduled session β†’ 100% full refund
  • Cancel 3–6 days before first session β†’ 50% refund (50% cancellation fee applies, reflecting tutor scheduling and preparation costs already incurred)
  • Cancel 0–2 days before first session β†’ No refund (tutor time has been reserved and cannot be reallocated)
  • Cancel before any session has been scheduled β†’ A 10% administrative processing fee applies (not exceeding EUR 25); the remaining balance is refunded, regardless of time elapsed since purchase. Where a session was previously scheduled and subsequently cancelled under Section 5.1 before any session was completed, the notice tiers in bullets 1–3 above apply based on the timing of the most recently cancelled session

4.2 Partial Cancellation (Some Sessions Completed).

If you wish to cancel after completing some sessions:

  • Completed sessions or hours: non-refundable (service has been provided)
  • Unused hours with 7+ days' notice before next session β†’ 100% refund of unused portion
  • Unused hours with 3–6 days' notice β†’ 50% refund of unused portion
  • Unused hours with less than 48 hours' notice β†’ No refund
Example 1: You purchase 10 hours. 3 hours completed (30% of purchase value). You cancel with 10 days' notice. Refund: 100% of the remaining 70% of the purchase value.
Example 2: You purchase 10 hours. 3 hours completed (30% of purchase value). You cancel with 4 days' notice. Refund: 50% of the remaining 70% of the purchase value.
Example 3: You purchase 10 hours. 3 hours completed (30% of purchase value). You cancel with 1 day's notice. Refund: 0%.

4.3 Refund Processing.

All approved refunds will be processed within 14 calendar days of your cancellation request and returned via your original payment method. You will receive an email confirmation once the refund has been initiated. It may take an additional 3–5 business days to appear in your account depending on your bank or card issuer.

5. Individual Session Cancellation and Rescheduling

5.1 Cancellation with 24+ Hours' Notice.

Cancel at least 24 hours before the session start time: no penalty, the hour remains in your balance, free rescheduling available. Cancellation must be submitted via the Platform's booking system or by email.

5.2 Late Cancellation (Less than 24 Hours but More than 2 Hours).

50% of the session fee is deducted from your balance. The remaining 50% is automatically credited to your account balance and may be used toward any future session. Credits applied under this section are subject to the same validity period as the original purchase.

5.3 Same-Day Cancellation (Less than 2 Hours' Notice).

100% of the session fee is deducted from your balance. This compensates the tutor for time that cannot be reallocated at such short notice.

5.4 Student No-Show.

If you do not attend a scheduled session without prior cancellation, 100% of the session fee is deducted. The tutor waits 15 minutes from the scheduled start time. No make-up session or credit is provided for no-shows. No-show deductions under this section are final and are not subject to reversal under Section 4 or Section 3. A no-show does not constitute a completed session for the purposes of Section 3.2. The session fee deducted under this section reflects compensation for tutor time reserved and lost, not payment for a service rendered, and is non-refundable upon withdrawal.

5.5 Tutor Cancellation.

If your tutor cancels with advance notice, you receive a full credit for that session and are offered priority rescheduling. In the event of a tutor no-show, you will receive a full credit for that session, subject to One World Classroom's verification of the tutor's absence, and will be offered priority rescheduling.

6. Booking and Scheduling

6.1 Session Booking.

After making a purchase, schedule your sessions through the Platform's booking system. You will be matched with a qualified tutor based on your subject needs, preferred schedule, and tutor availability.

6.2 Advance Booking.

We recommend booking sessions at least 48 hours in advance. Same-day or next-day bookings are subject to tutor availability and cannot be guaranteed.

6.3 Rescheduling.

You may reschedule a session free of charge with at least 24 hours' notice. Rescheduling requests with less than 24 hours' notice are subject to the cancellation fees in Section 5.

6.4 Tutor Matching.

Our matching algorithm pairs you with the most suitable tutor based on subject expertise, availability, and ratings. After the first session, you may request a different tutor at no additional cost.

7. Student Obligations and Code of Conduct

7.1 Technical Requirements.

You are responsible for having a stable internet connection, working camera and microphone, and access to Zoom or Google Meet. Technical difficulties on your side do not entitle you to a refund or credit, subject to Section 8.

7.2 Punctuality.

Please join sessions on time. Technical setup is your responsibility and should be completed before the session start time. Late arrivals do not extend the session duration.

7.3 Respectful Conduct.

You agree to treat tutors with respect and professionalism. Harassment, discrimination, or inappropriate conduct of any kind will not be tolerated and may result in immediate account termination without refund.

7.4 Academic Integrity.

Our services are designed to help you understand course material, not to complete assignments or exams on your behalf. You agree not to use our services to cheat, plagiarise, or violate your institution's academic integrity policies. Violations may result in account termination.

7.5 Communication Channels.

All communication with tutors must occur exclusively through Platform-approved channels (Platform messaging, Platform email, or scheduled video sessions). You agree not to request or share personal contact details (phone numbers, personal email, social media) with tutors. Direct payments to tutors outside the Platform are strictly prohibited and will result in account termination for both parties.

8. Technical Issues and Force Majeure

8.1 Session Interruptions.

If a session is interrupted by technical issues: less than 15 minutes completed β†’ full credit, session rescheduled at no charge. 15–45 minutes completed β†’ 50% charge, remaining time to be completed in a future session. More than 45 minutes completed β†’ full session charge, session considered complete. For the purposes of this section, interruption thresholds are assessed against the total duration of the booked session.

8.2 Responsibility for Technical Failures.

If the interruption was caused by your equipment or internet: you are charged per Section 8.1 and responsible for rescheduling. If caused by the tutor: you receive a full credit and priority rescheduling. If caused by the Platform or video service (Zoom, Google Meet): both parties are held harmless, session rescheduled at no charge.

8.3 Force Majeure.

Neither party is liable for failures due to events beyond reasonable control, including natural disasters, war, civil unrest, government orders, widespread power outages, or internet infrastructure failures. Sessions affected by force majeure will be rescheduled when conditions permit. Where a purchase validity period under Section 2.3 would otherwise expire during or immediately following a force majeure event, the validity period is automatically extended by 30 days from the date conditions permit normal operations to resume.

9. Privacy and Data Protection

9.1 GDPR Compliance.

We process your personal data in accordance with the GDPR (Regulation (EU) 2016/679) solely for the purpose of providing tutoring services. You have the right at any time to access, rectify, erase, and receive a portable copy of your personal data. Contact: info@oneworldclassroom.de.

9.2 Data Sharing.

We share your name and basic contact details exclusively with your assigned tutor. We do not sell or share personal data with third parties for marketing purposes. Payments are processed securely via Stripe.

9.3 Session Recordings.

Sessions are recorded only with your explicit consent at the start of each session. Recordings are stored securely for 90 days and then permanently deleted.

9.4 Data Retention.

We retain account information and transaction records for 10 years as required by applicable tax law. Upon account deletion, personal data will be anonymised while transaction records are retained for legal compliance.

10. Limitation of Liability

10.1 Services Provided As Is.

Our tutoring services are provided without express or implied warranties of any specific academic outcome, exam grade, or grade improvement.

10.2 Liability Cap.

To the maximum extent permitted by applicable law, One World Classroom's total liability is limited to the amount you paid for the purchase giving rise to the claim. We are not liable for indirect damages, lost profits, or data loss.

10.3 Platform Availability.

We aim for 99% platform uptime but cannot guarantee uninterrupted access. We are not liable for temporary unavailability due to maintenance or technical issues.

11. Dispute Resolution

11.1 Customer Support.

For complaints or disputes, contact info@oneworldclassroom.de. Most issues are resolved within 2–3 business days.

11.2 Informal Resolution.

Before formal legal proceedings, One World Classroom commits to seeking an informal solution through good-faith discussions for at least 30 days. One World Classroom is neither obligated nor willing to participate in formal dispute resolution proceedings before a consumer arbitration board (Β§ 36 VSBG).

11.3 EU Online Dispute Resolution.

The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Our email address for ODR purposes is info@oneworldclassroom.de.

11.4 Governing Law.

These Terms are governed by the laws of the Federal Republic of Germany. As a consumer, you retain any mandatory consumer protection rights under the law of your country of residence.

12. Changes to These Terms

12.1 Right to Amend.

We reserve the right to amend these Terms at any time. We will notify you of material changes at least 14 days before they take effect by email to the address registered on your account.

12.2 Right to Exit.

If you do not agree with amended Terms, you may close your account and request a refund for the pro-rata value of any unused hours within 14 days of receiving notice of the changes. Continued use of the Platform after the effective date of changes constitutes acceptance of the amended Terms.

13. Account Termination

13.1 Termination by Student.

You may close your account at any time by contacting info@oneworldclassroom.de. Refunds for unused hours are processed per Section 3 where termination occurs within the 14-day statutory withdrawal period, and per Section 4 thereafter.

13.2 Termination by Platform.

We may suspend or close your account immediately for: breach of these Terms, fraudulent activity, harassment or abuse of tutors, repeated no-shows without notice, violations of academic integrity policies, or misrepresentation of age where the student is under 18 and has not provided verifiable parental or guardian consent. Unused hours are forfeited without refund upon termination for cause.

13.3 Effect of Termination.

Upon termination, Platform access is revoked and scheduled sessions are cancelled. Personal data is handled per our Privacy Policy and GDPR. Provisions that by their nature survive (liability, dispute resolution, governing law) remain in force.

14. General Provisions

14.1 Entire Agreement.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and One World Classroom.

14.2 Severability.

If any provision is found invalid or unenforceable, the remaining provisions continue in full force. The invalid provision is replaced by a valid one that most closely reflects the original intent.

14.3 Waiver.

Failure to enforce any provision does not constitute a waiver of that provision or the right to enforce it in the future.

14.4 No Assignment.

You may not transfer or assign your rights under these Terms without our prior written consent.

14.5 Language.

These Terms are drawn up in English. The authoritative version for German legal purposes is the German-language AGB (Allgemeine GeschΓ€ftsbedingungen). In the event of any conflict, the German version shall prevail.

Student Acknowledgement

By clicking "I Agree" or by purchasing a tutoring package, you confirm the following:

  1. You have read and understood these Terms and Conditions in their entirety
  2. You agree to be bound by all provisions of these Terms
  3. You have taken note of the cancellation and refund policies in Sections 4 and 5
  4. You have taken note of your booking and scheduling obligations under Section 6
  5. You have taken note of your obligations and code of conduct under Section 7, including respectful conduct toward tutors, academic integrity, and the prohibition on direct contact and direct payments outside the Platform
  6. You have taken note of your EU consumer rights under Section 3, including the 14-day statutory right of withdrawal
  7. By booking your first session, you expressly request that One World Classroom begins providing services immediately. You acknowledge that your right of withdrawal expires upon full completion of each session, as set out in Section 3.2, and that this acknowledgement constitutes your consent under Β§ 356 Abs. 4 BGB
  8. You are at least 18 years old or have parental/guardian consent to use our services
  9. You understand that One World Classroom does not guarantee specific academic outcomes or results

If you do not agree with these Terms, please do not use our services or make any purchases.
